Abstract

Speaking of real right presupposes the existence of a thing which will fall on the conduct of the owner authorized, meaning thing or the 'res', name used by the Romans referring to every object in the outside world that can produce a profit by men. According to Roman law, not everything can be subject to private appropriation, these things were out of the trade (extra commercium) and things that were able to appropriate individuals if they were as they were within the commercium (res in commercium).
