Abstract

This paper presents a solution regarding the allegedly existence of a material and a formal judicial review. In our opinion such distinction is not accurate. There are no bases from an historical judicial review perspective. Precedents of federal courts give us enough examples for not using anymore a distinction between material and formal judicial review.
